For Rent By Owner Rules. By listing your apartment for rent through the Site's For Rent By Owner service ("FRBO"), you acknowledge and agree that: (a) you own or have the right to advertise the apartment you list for rent; (b) you have the right to lease the advertised apartment; (c) you are willing to lease the advertised apartment at the price and on any other terms specified in your listing; (d) you will purchase only one FRBO listing per unique apartment unit and you will not advertise more than one apartment unit in a single FRBO listing, either by including descriptions of multiple apartments in one listing or by subsequently updating the listing information to advertise different apartments; (e) upon leasing or otherwise taking your apartment off the market, you will within 72 hours delete the listing for that apartment; (f) you will not use your FRBO listing to advertise or promote anything (including, without limitation, any product, service or business) other than one unique apartment unit offered for rent; (g) except as provided in Apartments.com's current Refund Policy, you will pay Apartments.com for your FRBO listing, even if you fail to lease your apartment or are dissatisfied with FRBO; (h) if you placed a FRBO listing with a material error that cannot be corrected through the FRBO tools, you will contact Apartments.com customer service within 10 days of your original listing date to inquire about making material changes to your listing (e.g., through a typographical error, you listed the wrong model for rent) and Apartments.com shall determine, in its sole discretion, whether such changes will be permitted; (i) you will not use your FRBO listing or the Site for any fraudulent, false, misleading or deceptive activity; (j) all Materials that you provide to Apartments.com is truthful, accurate and complete and complies with all local, state and federal laws and regulations, including without limitation, fair housing laws; (k) you are solely responsible for any and all FRBO listings, and all content, photos, data or other Materials you submit to the Site; (l) you have the all rights necessary to post your FRBO listings, including, without limitation, all content, photos, data and other Materials contained therein, on the Site; and (m) photos provided for the FRBO listing will only show the apartment listed for rent and shall not include under any circumstances people, animals, trademarked items, religious symbols, or other objects or features not part of the apartment or apartment community. Apartments.com reserves the right, in its sole discretion, to remove any FRBO listing or photo, without notice and without liability or providing a refund, that does not meet the requirements of these FRBO Terms & Conditions, the Site's Terms of Service, Apartments.com's policies, or if Apartments.com otherwise determines or believes, in Apartments.com's sole and exclusive discretion, that your FRBO listing or any photo or other content you upload is inappropriate for any legal, business, technical or other reason.

FRBO Listing Details. Currently, Apartments.com offers various FRBO listings packages. Features included with each listing package vary depending on the market, as determined by the zip code where the apartment is advertised for rent. FRBO listings packages vary on the following features:

Run time: The number of days at a time the FRBO listing appears on the Site.

Renewals: Some listings packages cannot be renewed without purchasing a new FRBO listing. These FRBO listings will be permanently removed from the Site on their stated end dates. If you choose to delete and then reinstate a FRBO listing that does not include renewals prior to its stated end date, you may reinstate it only prior to the stated end date. Once reinstated, your FRBO listing will appear on the Site only until the stated end date, when it will be permanently removed from the Site.

Some FRBO listings packages include the ability to continue the ad (at no cost) until the advertised apartment leases, up to 180 days (6 Month Enhanced Listing). If you purchased a 6 Month Enhanced Listing, your FRBO listing will be automatically removed from the Site every 60 days unless you return to the Site every 60 days to continue your FRBO listing at no cost, up to a maximum of 180 days or three continuation cycles. After the 180-day period, your FRBO listing will no longer available for free continuations and you will be required to purchase a new FRBO listing at the then-current price and duration.

Photos: Apartments.com FRBO listings packages include from 0 - 5 photos of the actual advertised apartment or apartment community.

GENERAL LIMITATIONS. FRBO listings only contain the features expressly indicated. In some cases, different features are available to other Apartments.com advertisers that are not available to you. FRBO listings may not appear on the Site for up to 3 hours. APARTMENTS.COM DOES NOT MAKE AND EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES TO YOU REGARDING THE FOR RENT BY OWNER SERVICE, INCLUDING, WITHOUT LIMITATION, ANY REPRESENTATIONS OR WARRANTIES THAT YOU WILL LEASE YOUR APARTMENT, OBTAIN AN ACCEPTABLE RENT FOR YOUR APARTMENT, ONLY RECEIVE LEGITIMATE INQUIRIES OR SOLICITATIONS FROM QUALIFIED RENTERS, OR RECEIVE ANY INQUIRIES REGARDING YOUR APARTMENT FOR RENT.

Apartments.com reserves the right to, but is under no obligation to and does not assume any obligation to, review FRBO listings before and/or after they are posted to the Apartments.com site to confirm information relating to the advertiser and the advertised apartment and to investigate complaints and suspicious activity. If Apartments.com determines, in its sole and exclusive discretion, that you are engaging in any unfair, deceptive, false, misleading or fraudulent practices, or that your listing violates any laws or guidelines, Apartments.com reserves the right to reject or immediately remove your listing from the Apartments.com site without notice and without liability or providing a refund, as described above.

FRBO Refund Policy. As a general matter, Apartments.com does not provide refunds for FRBO listings after a listing is purchased except if you mistakenly purchased (either through the Site or through one of Apartments.com's newspaper or broadcast affiliates) a duplicate listing for the same apartment and both appear on the Site at the time of your request. In order to be eligible to receive a refund under this circumstance, Apartments.com must receive your refund request in the manner described below within 5 calendar days of your purchase of the second FRBO listing.

Apartments.com further reserves the right to make refunds at any time in connection with cases of fraud, abuse, and in other limited instances. Apartments.com does not provide refunds under any other circumstances. Notwithstanding anything in this policy to the contrary, Apartments.com reserves the right to finally determine in its sole discretion whether the criteria for a refund set forth in this policy have been satisfied and to request any additional information relevant to such request.

All refund requests must be in writing and include your name, address, e-mail address, ad ID, apartment description, the last 4 digits of the credit card used to purchase the FRBO listing, and the reasons you are requesting a refund. Please send all refund requests to rentbyowner@apartments.com.

Apartments.com is not responsible for refund requests that are not timely received in accordance with this policy for any reason, including without limitation, Web congestion, addressing mistakes, computer or Internet downtime, or requests submitted by phone, postal mail, or any other manner not expressly provided for in this policy.

NOTE: The FRBO Refund Policy applies to online-only FRBO listings purchased on the Site. The FRBO Refund Policy does not apply to any listings that are purchased from one of Apartments.com's newspaper or other affiliates or partners as part of a print/online bundled package, even if such listings appear on the Site.
